Preamble
The training organization European Academy of Excellence (EAE), SIRET 10256383000011, whose registered office is located at 15 RUE GASTON TESSIER, 75019 PARIS, organizes and delivers professional training courses. Its training provider activity is registered with the DREETS of the Île-de-France Region under number 11757572475; this registration does not constitute State approval.
The signature by the Client of these General Terms and Conditions of Sale (hereinafter “GTC”) implies their full and unconditional acceptance. The GTC shall prevail over any other Client document, and in particular over any general purchasing conditions, unless a framework agreement or specific commercial agreement has been established with the client. All other documents from European Academy of Excellence (EAE), such as brochures or catalogues, are provided for informational purposes only. The fact that European Academy of Excellence (EAE) does not assert any of the present conditions at a given time shall not be interpreted as a waiver of the right to assert them at a later date.
1 — Registration
You can register by telephone at 759229140, by email at info@eae-paris.fr, or by postal mail to the following address: European Academy of Excellence (EAE) – 15 RUE GASTON TESSIER, 75019 PARIS. Your registration will be processed upon receipt of the professional training agreement or contract, as well as these present GTC, duly signed and stamped with a company seal (if applicable).
For remote training courses, it is the participant’s responsibility to verify that their computer hardware and setup meet the necessary requirements well in advance of the scheduled session.
2 — Cancellation – Replacement
To be taken into account, all cancellations must be communicated in writing.
Participant substitutions are permitted at any time, free of charge, provided that European Academy of Excellence (EAE) is notified in writing and provided with the name(s) and contact details of the replacement(s) no later than the day before the training session.
You may cancel a registration free of charge provided that you notify European Academy of Excellence (EAE) by registered letter with acknowledgment of receipt, or by email with acknowledgment of receipt sent to info@eae-paris.fr, received at least fourteen [14] calendar days before the training date.
In the event of a cancellation received less than fourteen [14] calendar days before the start of the training (or the first module for multi-session or remote training programs), the full registration amount remains due to European Academy of Excellence (EAE).
Any training session for which the participant did not attend or only attended partially remains payable in full.
3 — Rates – Payment
All rates are stated excluding taxes and are subject to applicable duties and taxes in force.
Our rates include the training, educational documentation provided during the training, and any electronic files made available where applicable. For questions regarding our pricing terms, please contact our Customer Service department at 759229140 or by email at info@eae-paris.fr.
Unless otherwise agreed, full payment must be made prior to the start of the training, in cash and without discount upon receipt of the invoice. In case of payment handled by an OPCO (Skills Operator), the financing agreement from your OPCO must reach us before the 1st day of the training. If European Academy of Excellence (EAE) has not received the financing agreement, you will be billed for the entire cost of the training. In the event of partial coverage by the OPCO, the uncovered portion will be billed directly to you.
Any invoice not paid by the due date shall automatically accrue interest at the interest rate applied by the European Central Bank to its most recent refinancing operation, plus 10 (ten) percentage points.
Failure to pay any single invoice on its due date will cause the entire amount owed by the Client to become immediately due and payable.
Any invoice collected through our litigation/debt collection services will be increased, by way of a non-reducible penalty clause within the meaning of Article 1231-5 of the French Civil Code, by an indemnity set at 15 (fifteen)% of the overdue amounts.
4 — Liability – Indemnities
The employer, or where applicable the participant, agrees to purchase and maintain, prior to and for the duration of the training, civil liability insurance covering bodily injury, property damage, consequential, direct, and indirect damage likely to be caused by their actions or those of their employees to the detriment of European Academy of Excellence (EAE) or other participants. They also agree to purchase and maintain civil liability insurance designating European Academy of Excellence (EAE) as an additional insured for all acts harmful to third parties caused by their employee, containing a waiver of subrogation clause, so that European Academy of Excellence (EAE) cannot be held liable or pursued.
5 — Right of Supervision / Right of Control
European Academy of Excellence (EAE) reserves the right, if the number of participants in a training course is deemed pedagogically insufficient, to cancel the training no later than fourteen [14] calendar days before the scheduled date.
European Academy of Excellence (EAE) reserves the right to postpone the training, change the location, modify program content, or replace an instructor if circumstances beyond its control require it.
European Academy of Excellence (EAE) reserves the right, without compensation of any kind:
- To refuse any registration or access to a Client who is not up to date with their payments.
- To exclude any participant who provided false statements during registration, without any compensation.
6 — Intellectual Property
In accordance with the intellectual property rights attached to the course materials or other educational resources provided exclusively to training participants, the Client is prohibited from reproducing, directly or indirectly, in whole or in part, adapting, modifying, translating, performing, marketing, or distributing to members of its staff who did not participate in European Academy of Excellence (EAE) training courses or to third parties, said materials and educational resources without the express, prior written authorization of European Academy of Excellence (EAE) or its rights holders.
7 — Data Protection and Privacy
European Academy of Excellence (EAE) commits to collecting and processing your personal data in accordance with French Law No. 78-17 of January 6, 1978, as amended, relating to information technology, files, and civil liberties (known as the “Data Protection Act”) and Regulation (EU) No. 2016/679 of April 27, 2016 (known as the “General Data Protection Regulation” or “GDPR”).
This policy outlines how European Academy of Excellence (EAE) undertakes to collect, use, and protect your personal data.
In accordance with the provisions of Articles 39, 40, 41, and 42 of amended Law 78-17 of January 6, 1978, you may exercise your rights of access, rectification, and objection by contacting: European Academy of Excellence (EAE) – 15 RUE GASTON TESSIER, 75019 PARIS or by telephone at 759229140.
8 — Applicable Law – Jurisdiction
THIS AGREEMENT IS GOVERNED BY FRENCH LAW.
In the event of a dispute concerning the interpretation or execution of any of these provisions, and failing an amicable settlement between the parties, exclusive jurisdiction is granted to the Commercial Court having jurisdiction over the registered office of the training organization.
